Terms & Conditions

These Terms govern the use of our marketplace (inventory + dropshipping).

These Terms & Conditions ("Terms") govern your access to and use of the website, mobile site, apps, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1) About the Company & Scope

  • Legal entity name: Mommy Maven Ventuers Pvt Ltd
  • Place of registration / governing courts: Jammu

We operate a hybrid model: (a) we sell and fulfil certain products from our own inventory (Seller-of-Record), and (b) we also facilitate sales by third‑party sellers via dropshipping (Marketplace Intermediary). These Terms apply to both models.

2) Acceptance of Terms & Updates

  • Your use of the Platform and/or placing an order constitutes acceptance of these Terms.
  • We may update these Terms at any time. Continued use after the \"Effective date\" constitutes acceptance of the updated Terms.

3) Eligibility, Account & Security

  • You must be 18 years or older and capable of entering a valid contract.
  • You agree to provide accurate information and keep your login credentials secure. We may suspend or terminate accounts for suspected fraud, abuse, or policy breaches.

4) Product Information & Availability

  • Product images are illustrative; actual colour/finish/pack-size may vary within reasonable limits.
  • We try to keep listings current; however, availability is subject to change and errors/omissions may occur.

5) Pricing, Taxes & Fees

  • Prices are in INR. Taxes (including GST) and any shipping/handling fees are shown at checkout.
  • In case of pricing or listing errors, we may cancel the order and process a full refund.

6) Order Process & Contract Formation

  • After you place an order, you will receive an order acknowledgement email/SMS. This does not signify acceptance.
  • The contract is formed when we dispatch the product(s) (inventory model) or when the third‑party seller confirms dispatch (dropship model).
  • We may cancel all or part of an order due to stock limitations, payment issues, address unverifiable, or suspected misuse.

7) Payment Terms

  • Accepted methods: UPI, Credit/Debit Cards, Net Banking/IMPS (if available), and Cash on Delivery (COD where serviceable).
  • For COD: limits may apply; repeated refusals or fake orders may lead to COD being disabled for your account.
  • EMI, wallet, or BNPL (if offered) are subject to respective provider terms.

8) Shipping, Delivery & Risk of Loss

  • Serviceable locations and delivery estimates are shown at checkout; estimates are not guarantees.
  • We may split shipments by item or seller.
  • Risk and title transfer to you on delivery to the shipping address (proof of delivery/OTP where applicable).
  • Undeliverable shipments (incorrect address/phone, repeated delivery attempts failed) may be returned; re‑delivery may attract additional charges.

9) Dropshipping, Pre‑orders & Backorders (Marketplace Intermediary)

  • For dropship items, products are stocked and shipped by third‑party sellers directly to you.
  • Handling/dispatch times may vary by seller; we display the best available estimate.
  • In rare cases, pre‑orders or backorders may be delayed; you may cancel before dispatch for a full refund.

10) Returns, Replacements & Refunds — 15‑Day Window

  • You can request a return or replacement within 15 days of delivery for eligible items, subject to the conditions below.
  • Condition: items must be unused, in original packaging with all tags, freebies, and invoices.
  • Non‑returnable categories (illustrative): personal care items once opened/used; consumables/food/perishables; intimate/hygiene items; made‑to‑order or customised products; final‑sale items; digital downloads.
  • Defective/DOA: If you receive a damaged, defective, or wrong item, contact us within 48 hours with unboxing photos/video; we will arrange replacement or refund as applicable.
  • Return logistics: We may provide a pickup. If pickup is unavailable, you may be asked to self‑ship with a trackable courier; reimbursable as per policy.
  • Inspection: Refunds are initiated after quality check at the warehouse/seller location. Partial refunds may apply for missing/damaged parts not due to transit defect.
  • Refund timelines: Typically 5–7 business days to the original payment method after inspection completion. COD refunds are via UPI/bank transfer/wallet as available.

11) Cancellations

  • By you: You may cancel before dispatch from our warehouse/seller; post‑dispatch cancellations are treated as returns.
  • By us: We may cancel for reasons including stockouts, address unverifiable, pricing/listing error, or suspected fraudulent activity; a full refund will be issued.

12) Promotions, Coupons, Gift Cards & Store Credit

  • Unless stated, one code per order; cannot be combined with other offers.
  • Exclusions may apply (e.g., already discounted items, specific brands).
  • Gift cards/store credits are promotional, non‑interest‑bearing, and may have an expiry date.

13) Warranties & Manufacturer Support

Where applicable, products may carry brand/manufacturer warranties. Warranty claims follow the manufacturer’s process. You may need to contact an authorised service centre.

14) Reviews, User Content & Conduct

  • By posting reviews, Q&A, images, or other content, you grant us a worldwide, royalty‑free licence to use and display such content.
  • Prohibited: unlawful, defamatory, obscene, infringing, or misleading content; spam; impersonation; scraping or reverse engineering of the Platform.

15) Intellectual Property

All Platform content (text, graphics, logos, trademarks, product data) is our property or that of licensors/sellers. You receive a limited, revocable, non‑transferable licence to access and use the Platform for personal, non‑commercial purposes.

16) Third‑Party Services & Links

We use payment gateways, logistics partners, analytics, and other third‑party services. Their terms and privacy practices apply to their services.

17) Privacy & Data

Our Privacy Policy explains how we collect, use, and share personal data, cookies, and marketing preferences. By using the Platform, you consent to such processing.

18) Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages.
  • Our total liability for any claim is limited to the amount paid by you for the product(s) giving rise to the claim.

19) Indemnity

You agree to indemnify and hold us harmless from losses arising out of your breach of these Terms, misuse of the Platform, or violation of law/third‑party rights.

20) Force Majeure

We are not responsible for delays or failure to perform due to events beyond reasonable control (natural disasters, strikes, lockdowns, governmental actions, network outages, etc.).

21) Governing Law, Dispute Resolution & Jurisdiction (India)

  • These Terms are governed by the laws of India. Courts at Jammu shall have exclusive jurisdiction.
  • If we specify arbitration/mediation in the future, the seat will be Jammu, conducted in English per the Arbitration & Conciliation Act, 1996.

23) Termination

We may suspend or terminate access for policy violations, fraud, or unlawful activity. Termination does not affect accrued rights or obligations for orders already dispatched.
